Kenya’s High Court Clears Senate to Debate Deputy President Gachagua’s Impeachment

Nairobi, Kenya Kenya’s High Court on Tuesday dismissed an application by Deputy President Rigathi Gachagua’s legal team, allowing the Senate to debate an impeachment motion against him. This ruling follows last week’s overwhelming 281-44 vote in parliament, which approved Gachagua’s removal from office and sent the matter to the Senate.

Justice Chacha Mwita ruled that parliament has a constitutional mandate and the court would not interfere with its proceedings.

Gachagua is facing accusations of corruption and other irregularities, including allegations of backing anti-government protests in June. He firmly denies the charges.

Under Kenya’s constitution, if the Senate approves the motion with a two-thirds majority, Gachagua would be automatically removed from office. The deputy president has indicated his intention to challenge the impeachment in court.

A three-judge panel has been appointed to hear six petitions opposing the impeachment process.

Public tension surrounding Gachagua’s fate has escalated, with supporters and opponents clashing in public forums last week.

President William Ruto has remained silent on the matter, although he has previously stated that he would avoid publicly embarrassing his deputy, referencing his strained relationship with former President Uhuru Kenyatta during their second term.

If the Senate approves the impeachment, Gachagua will become the first sitting deputy president in Kenya’s history to be removed from office.
